Terms of Service

1. Who these terms are with

These terms are an agreement between you and Ekstra ("Ekstra", "we", "us"), the operator of this service, whether you reach it at ekstrabuild.com or through a partner's website that uses Ekstra under the partner's own name (a "partner site"). On a partner site, Ekstra provides the design tools, your account and your reservation; the partner is a company that builds or supplies structures and may be the one you work with on your build. By creating an account, saving a design, requesting a price or reserving, you agree to these terms and to our Privacy Policy.

2. Your account

You must be at least 18 and able to enter a contract. Give us accurate information and keep your password to yourself; you are responsible for what happens under your account. Tell us at support@ekstrabuild.com if you think someone else has used it.

3. Designs, site plans and what they are not

• Concept designs. The studio produces concept designs, floor plans, 3D models and drawings to help you choose and price a structure. They are not construction documents and have not been reviewed by a licensed architect or engineer for your site.
• Site plans. Lot lines, existing buildings, roads and setbacks come from public records and third-party data (county and state GIS, the U.S. Census Bureau, OpenStreetMap and others). They can be out of date or wrong. A site plan is a planning study, not a survey, and setback figures are typical values unless we say otherwise. Confirm your boundaries with a licensed surveyor and your requirements with your local jurisdiction before you rely on them.
• Permits and codes. You are responsible for zoning approval, permits, inspections, utility connections and meeting the codes that apply to your property, unless you have a separate written agreement that says otherwise.

4. Prices and quotes

Prices shown are estimates until they are quoted for your design and address. A quote for the steel frame comes from an independent fabricator and is valid for the period it states; after that it may change. Quotes do not include site work, foundations, delivery conditions beyond those stated, permits, finishes or installation unless the quote says so.

5. Reservations

• A reservation is $1,500 unless a different amount is shown at checkout. It pays for your plan set, your site plan and the feasibility work we begin straight away, and it holds a fabricator slot for your build.
• It is non-refundable. It is not a deposit against the price of your build. Where the law gives you a right to cancel within a set period, that right still applies.
• In California, the reservation for a conditioned building (a backyard house or a Space) includes the Title 24 Prep Package, $750. The Title 24 Prep Package gives your energy consultant everything needed to produce your CF1R Certificate of Compliance: specified assemblies, rated windows and doors, equipment, ventilation, lighting controls, and a proposed solar layout. It is not a CF1R. Before permit, a licensed energy consultant must model your design, sign the CF1R, and register it with a HERS provider, and a HERS rater will verify certain items during construction. Those services are contracted separately. A free design switch covers a design whose reservation costs no more than the one being moved.
• Each reservation includes one free design switch. If you reserve one design and then choose a different one, you can move your reservation to the new design once at no charge; the first design's plans and site plan are then withdrawn. After that switch, a further new design needs its own reservation at the full fee. A reservation cannot be moved once its build has gone to the fabricator.
• Payments are processed by our payment provider; we do not store your card details.
• Reserving does not commit you to building, and it does not commit a fabricator to a price after your quote expires.

6. Plan changes

If you ask us to customize your plans, we tell you the price and the time it will take before you pay. Customization fees are non-refundable once work has started.

7. Fabricators, builders and partners

Steel frames are fabricated by independent fabricators, and your build may be carried out by a partner or contractor. They are responsible for their own work under their own agreements with you. Ekstra is not a contractor and does not perform construction unless a separate written agreement says it does.

8. What you may do with the plans

We license you to use the designs, plans and site plans you receive to plan, permit and build that structure at the property they were prepared for. You may not resell them or use them for other properties or other people without our written permission. Ekstra and its licensors keep all rights in the service, the designs and the software.

9. Your content

You keep ownership of what you give us (addresses, designs you make, messages, photos). You allow us to use it to run the service for you, including sharing it with the partner whose site you use and with fabricators involved in your build.

10. Acceptable use

Do not misuse the service: no attempts to break in or overload it, no scraping, no using it to infringe anyone's rights or break the law.

11. Disclaimers

Except as the law requires, the service, designs, site plans and data are provided "as is". We do not promise that the service will be uninterrupted or error-free, or that public data about your property is accurate.

12. Limitation of liability

To the extent the law allows, Ekstra is not liable for indirect, incidental or consequential losses, and our total liability for any claim relating to the service is limited to the amounts you paid Ekstra in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

13. Ending your account

You can close your account at any time by contacting us. We may suspend or close accounts that break these terms. Sections that by their nature should continue (licenses you already received, payments, disclaimers, limits of liability) survive.

14. Changes

We may update these terms. If a change is material we will tell you by email or in the service before it takes effect. Continuing to use the service after that means you accept the new terms.

15. Governing law

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules, and disputes will be heard in the state or federal courts located in Utah, unless the law of the state where you live requires otherwise.
